The Treasury Emergency Rental Assistance (ERA) program included an unprecedented amount of funding for emergency rental assistance to help renters stay stably housed. The December 2020 COVID-19 relief package included $25 billion (ERA1) in urgently needed emergency rental assistance for tenants with low incomes and established the Emergency Rental Assistance program under the administration of the U.S. Department of the Treasury. The “American Rescue Plan Act,” enacted in March 2021, provided an additional $21.55 billion (ERA2) for a grand total of $46.55 billion in emergency rental assistance. States, the District of Columbia, territories, tribal governments or tribally designated housing entities, the Department of Hawaiian Home Lands, and local governments with more than 200,000 residents were eligible to administer a local program as part of the federal Treasury ERA program.

The Centers for Disease Control and Prevention (CDC) order directing landlords to stop most evictions for nonpayment of rent from August 3 through October 3, 2021, for communities experiencing a substantial or high level of COVID transmission was terminated by the U.S. Supreme Court on August 26. Some states and localities have extended their own eviction moratoriums and other protections. See if your state has an extended moratorium here.

The CARES Act requires landlords to provide a 30-day notice to tenants prior to eviction. This Act covers properties supported by HUD, USDA, and Treasury (Low Income Housing Tax Credit), and properties with federally-backed mortgages (e.g., FHA, Fannie Mae, and Freddie Mac). This searchable database allows some renters to identify if their apartment is covered by the CARES Act.
